V EFFECT Terms of Service

These Terms of Service (hereinafter referred to as the "Terms") govern the terms and conditions for using the mobile application "V EFFECT" (hereinafter referred to as the "App"). Please read these Terms carefully before installing or using the App.

Article 1 (Applicability)

These Terms shall apply to all relations between the user (hereinafter referred to as the "User" or "you") and the developer/operator (hereinafter referred to as the "Operator," "we," "us," or "our") regarding the use of the App.

Article 2 (User Registration and Account Management)

1. Any person wishing to use the App must agree to these Terms and register for an account in accordance with the method prescribed by the Operator.
2. Users shall be responsible for appropriately managing and safeguarding their account credentials (including usernames and passwords). Users must not permit any third party to use their account, nor may they lease, transfer, change the name of, or sell their account to any third party.
3. Any damages or liability arising from inadequate management of account credentials, errors in use, or unauthorized use by a third party shall be borne entirely by the User, and the Operator shall assume no responsibility for such damages.
4. The App is intended for users who are 13 years of age or older. Persons under the age of 13 are not permitted to use the App.

Article 3 (Service Description)

The App is a positive-reinforcement social networking service (SNS) designed to support personal growth and maintain motivation, primarily providing the following features:

• Sharing the process of daily efforts accompanied by photographs.
• Visualizing self-growth (streak features).
• A lock feature (guarded-by-post mechanism) where only users who have made their own daily post can view the posts of other users within a limited community (such as friends).
• Sending praise and positive feedback to other users' posts.

Article 4 (Prohibited Activities)

When using the App, Users must not engage in any of the following activities:

1. Any act that violates, or facilitates the violation of, applicable laws, regulations, court judgments, decisions or orders, or legally binding administrative measures.
2. Acts contrary to public order or standards of decency (public morals).
3. Acts that infringe upon the copyrights, trademarks, or other intellectual property rights, image rights (portrait rights), privacy rights, reputation, or other rights or interests of the Operator, other users, or any third party.
4. Posting or transmitting content containing violent, obscene, or discriminatory expressions, or content that causes discomfort or offense to other users, contrary to the purpose of the App.
5. Acts aimed at meeting unfamiliar third parties (non-acquaintance dating or encounters).
6. Acts that impose an excessive load on the features, network, or systems of the App, or intentionally exploiting bugs, glitches, or system vulnerabilities (including the unauthorized use of cheat tools or exploits).
7. Impersonating the Operator, another user, or any third party.
8. Harvesting, collecting, or accumulating other users' personal information without their prior consent.
9. Any other acts deemed inappropriate by the Operator.

Article 5 (Rights to Content)

1. Copyright and other intellectual property rights in and to the photographs, text, and other content posted by the User on the App (hereinafter referred to as "Posted Data") shall remain with the User or the third party who licensed it to the User.
2. The User hereby grants the Operator a royalty-free, non-exclusive, worldwide, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display the Posted Data, solely within the scope of providing, improving, promoting, and advertising the App.
3. The User represents and warrants to the Operator that they possess all necessary legal rights to the Posted Data and that the Posted Data does not infringe upon the rights of any third party.

Article 6 (Suspension of the App)

The Operator may suspend or interrupt the provision of all or part of the App without prior notice to Users if the Operator determines that any of the following circumstances apply:

1. When performing maintenance, inspections, or updates of the computer systems related to the App.
2. When the provision of the App becomes difficult due to force majeure, including but not limited to earthquakes, lightning, fires, power outages, or natural disasters.
3. When telecommunication lines or services are suspended due to accidents or network disruptions.
4. In any other case where the Operator deems it difficult to provide the App.

Article 7 (Use Restrictions and De-registration)

If a User violates any provision of these Terms, or if the Operator deems the User's use of the App to be inappropriate, the Operator may, without prior notice, restrict the User's use of all or part of the App, or terminate the User's registration.

Article 8 (Account Deletion / Withdrawal)

Users may delete their account and withdraw from the App at any time by following the account deletion procedures designated by the Operator within the settings screen of the App.

Article 9 (Disclaimer of Warranties and Limitation of Liability)

1. The Operator makes no warranties, express or implied, regarding the App, including but not limited to any warranty that the App is free from factual or legal defects (including safety, reliability, accuracy, completeness, or security vulnerabilities).
2. Except in cases of willful misconduct or gross negligence by the Operator, the Operator shall not be liable for any damages incurred by the User arising out of or in connection with the use of the App. Even if the Operator's disclaimer of liability is not permitted under the Consumer Contract Act of Japan or other applicable laws, the Operator's liability for damages caused by its negligence (excluding gross negligence) for breach of contract or tort shall be limited to direct and ordinary damages actually incurred by the User.
3. The Operator shall assume no responsibility or liability for any transactions, communications, or disputes that may arise between the User and other users or third parties in connection with the App.

Article 10 (Modification or Termination of Services)

The Operator reserves the right to modify, suspend, or terminate the contents, specifications, or provision of the App at any time without prior notice to the Users, and shall not be liable for any damages incurred by Users as a result of such modifications, suspension, or termination.

Article 11 (Amendments to the Terms)

The Operator may amend these Terms at any time. The amended Terms shall be made known to Users through postings within the App or update notifications. By continuing to use the App after such notification has been made, the User shall be deemed to have agreed to the amended Terms.

Article 12 (Handling of Personal Information)

Personal information acquired through the use of the App shall be handled appropriately in accordance with our separate Privacy Policy.

Article 13 (Severability)

If any provision of these Terms or any part thereof is held to be invalid or unenforceable under applicable laws, the remaining provisions of these Terms shall continue in full force and effect.

Article 14 (Governing Law and Jurisdiction)

1. These Terms shall be governed by and construed in accordance with the laws of Japan.
2. Any dispute arising out of or in connection with the App shall be subject to the exclusive jurisdiction of the Niigata District Court or the Niigata Summary Court as the court of first instance.
